Short Summary This act guarantees full autonomy to operate and manage all the functionality of the school ensuring high level of education, to counter the socio-cultural and territorial inequalities, to prevent and recover the abandonment and early school leavers, in line with the educational, cultural and professional integration of different levels of education, to build a school open, as a permanent research laboratory, experimentation and educational innovation. The forms of flexibility and organizational autonomy envisaged by the regulations the decree of the President of the Republic March 8, 1999, n. 275 contribute to the realization of the school curriculum, achievement of objectives, teaching collaboration and design as well as interaction with families and the territory.
In order to give full effect to the implementation process the entire system of autonomy and reorganization of education, and it sets up for the entire educational institution as well as keeping with requirements educational, organizational and planning of schools a three-year plan of training is prepared pursuant to paragraph 14 (Art. 1/5). The schools provide, by the end of October of the previous school year referring to the last three-year period, the new three-year plan of training. It contains the planning of training activities for teaching staff and administration, technical and auxiliary, as well as the definition of necessary resources according to the quantification arranged for educational institutions. The plan can 'be revised annually by the end of October. The regional education office verifies that the three-year plan respects the limits assigned to each school (Art. 1/12).
Further the Act foresees that educational institutions promote, within the three-year plans and the training offer in collaboration with the Ministry of Education, University and research activities consistent with the purpose, the principles and the instruments foreseen in the National Plan for the digital school referred to in paragraph 56 (Art. 1/57) It has the objective to improve digital competences of the students with collaboration of universities, associations, organizations of the third sector and enterprises, promote innovation and exchange of information and data etc. (Art. 1/58).
The National Training Plan is adopted every three years by the Minister of Education, University and Research, in consultation with representative trade union organizations (Art. 1/124). For the implementation of the National Training Plan and for the implementation of training activities referred to in paragraphs 121 to 124 the expenditure of € 40 million per year with effect from the year 2016 is authorized (Art. 1/125).
For the school year 2015/16 the Ministry of education within the month of September grants each autonomous educational institution a distribution of the Operating Fund in relation to the portion corresponding to the period between September and December of the current school. At the same time, the Ministry shall preventively communicate further financial resources, taking into account of what may be required in the bill of stability, covering the period between January and August of the reference school year, that will be delivered within the resources recorded in the budget legislation no later than the end of February of the following financial year.
To promote the development of the teaching laboratory, the educational institutions, including through the technical and vocational institutions, can acquire territorial laboratories for employability through participation, even in quality of co-financiers, the public and local authorities, chambers of commerce, industry, trade and agriculture, universities', associations, foundations, vocational training centers, institutes senior technicians and private companies (Art. 1/60).
Commas 145-150 provides a school bonus which is a tax credit equal to 65% of donations made in 2015 and 2016 and 50% of those made in subsequent years for cash donations for investment in favor of all the institutions of the national education system, for the construction of new school facilities, maintenance and upgrading of existing ones, for supporting interventions that improve the employability of students. The law quantifies 62.4 million in lower revenues for the years 2016-2020.
Commas 151-152 include provisions on deductible expenses for private schools: Reintroduced the deductibility of 19% of the costs incurred by families for attendance of pupils in private schools for a maximum amount of 400 EUR per year of expenditure incurred.
Commas 153-158 the law provides for the allocation between the regions INAIL financing for the safety of the school buildings (art. 18, paragraph 8, Law 98/2013) for the realization of innovative school buildings from an architectural point of view, technology, plant engineering, energy efficiency and structural safety and seismic.
Commas 186-191 cover the situation of Bolzano: The autonomous province of Bolzano has the active and passive legitimacy in judicial proceedings relating to the teaching staff, managing and monitoring of statewide schools. The autonomous province of Bolzano will follow the state regulations on state exams with provincial law, in order to complement the national trails with cultural and linguistic aspects related to the local reality.
